The owner of the online store www.sniffy.ee (hereinafter the “Online Store”) is Sniffy OÜ (hereinafter “Sniffy”) (registry code 16557153).
1. Validity of the Terms of Sale, Product and Pricing Information
1.1. These terms of sale apply to purchases made from the Online Store. The terms of sale and the legislation in force in the Republic of Estonia regulate the legal relationship between Sniffy and the person purchasing products via the Online Store (hereinafter the “Customer”). Any differences in the terms of sale arising from the Customer’s status (e.g. private individual/consumer or legal entity) are based on the legislation in force in the Republic of Estonia.
1.2. The prices of products sold in the Online Store include VAT and product information is provided next to each product. Sniffy reserves the right to change product prices.
1.3. A delivery fee is added to the price, depending on the Customer’s location and the selected delivery method. The delivery fee is displayed to the Customer when placing the order.
2. Placing an Order
2.1. To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in and a suitable delivery method selected. The total amount payable will then be displayed on the screen and can be paid via bank link or other payment solution. Payments are processed by the payment service provider Montonio Finance UAB (registry code 3050205122), to whom Sniffy transmits payment-related Customer data.
2.2. The order is considered placed and fulfilled and the sales contract enters into force once the purchase amount has been received in Sniffy’s bank account. The order will be cancelled if the Customer has not paid the purchase amount within the time specified in the order confirmation.
2.3. If the ordered goods cannot be delivered, the Customer will be informed at the earliest opportunity and the paid amount will be refunded.
3. Delivery of Products
3.1. Sniffy uses the delivery method selected by the Customer when placing the order.
3.2. Sniffy and the transport company responsible for delivery are not liable for delivery delays or failures if the delay or failure is caused by inaccurate or incorrect information provided by the Customer when placing the order.
3.3. The Customer may notify Sniffy of products with damaged packaging by emailing [email protected].
3.4. Shipments within the Republic of Estonia generally reach the destination specified by the Customer within 5 working days from the entry into force of the sales contract. Pursuant to § 209(6) of the Law of Obligations Act, Sniffy has the right to deliver the products within up to 30 calendar days.
3.5. If it becomes apparent that the product ordered by the Customer is not in stock and cannot be delivered within the usual delivery time, Sniffy will contact the Customer as soon as possible using the contact details provided. Sniffy will inform the Customer of the estimated time when the product can be delivered. If the Customer has lost interest in the product due to the delay, the Customer has the right to withdraw from the contract and the paid amount will be refunded.
4. Right of Withdrawal
4.1. Products purchased from the Online Store are subject to a 14-day right of return. Pursuant to § 56(1) of the Law of Obligations Act, the Customer has the right to return products purchased from the Online Store without stating a reason within 14 days from the delivery of the product. To return a product, the Customer must first submit a withdrawal statement to Sniffy by email ([email protected]), including the Customer’s name, order date, bank account number, and order number. The Customer may use the withdrawal form available on the Online Store’s website. The Customer must return the ordered products to Sniffy within 14 days from submitting the withdrawal statement.
4.2. The Customer bears the costs related to returning products (e.g. postage).
4.3. Returned products must be unused, undamaged and in their original packaging. The returned product must include all items originally included in the packaging. To retain the right of withdrawal, the packaging must be opened carefully and the product examined in a way that does not damage it. Pursuant to § 53(4)(4-1) of the Law of Obligations Act, the 14-day right of withdrawal does not apply, among other things, to food and feed products with opened packaging.
4.4. In the event of withdrawal from the contract, Sniffy will refund all payments received from the Customer, including delivery costs (except for additional costs arising from the Customer’s chosen delivery method that differs from the cheapest standard delivery method offered by Sniffy), no later than 14 days from receiving the returned goods. Refunds will be made to the same bank account from which the Customer made the payment.
4.5. Sniffy has the right to withdraw from the sales transaction and demand the return of goods from the Customer if the product price in the Online Store was significantly below the market price due to an error.
5. Right to Submit a Complaint
5.1. Sniffy is liable for any non-conformity or defect of the goods sold to the Customer that existed at the time of delivery and becomes apparent within two years from delivery. During the first year from delivery, it is presumed that the defect existed at the time of delivery. The burden of proof to refute this presumption lies with Sniffy.
5.2. In the event of a defect, the Customer has the right to contact Sniffy within two months by sending an email to [email protected].
5.3. Sniffy is not liable for defects that have arisen after delivery due to the Customer’s actions or omissions (e.g. improper use, accident, etc.) or normal wear and tear resulting from ordinary use.
5.4. If the product purchased from Sniffy has defects for which Sniffy is responsible, Sniffy will repair or replace the defective product. If the product cannot be repaired or replaced, Sniffy will refund all fees related to the sales contract.
5.5. Sniffy will respond to the Customer’s complaint in writing or in a format that can be reproduced in writing within 15 days.
6. Disputes
6.1. If the Customer has complaints regarding the Online Store or Sniffy, they must be sent to [email protected].
6.2. Matters not specified in these terms of sale shall be resolved in accordance with the legislation in force in the Republic of Estonia.
6.3. If the Customer and Sniffy are unable to resolve a dispute through negotiations and agreement, the Customer may обратиться the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between the Customer and the Online Store. 7. Other Terms
7.1. All images, specifications and other information added to products sold in the Online Store are protected by copyright and their use without Sniffy’s permission is prohibited.
7.2. Sniffy reserves the right to amend these terms of sale. Amendments enter into force upon publication on the Online Store’s website www.sniffy.ee.
