Terms and conditions of sale

E-shop www.sniffy.ee (hereinafter E-shop) is owned by Sniffy OÜ (hereinafter Sniffy) (registration code 16557153).

This is an English translation of the terms of sale. When interpreting the terms, preference is given to the Estonian version of the terms, which can be found on the Estonian webpage of the e-shop.

  1. Validity of the conditions of sale, commercial and price information

1.1. The terms and conditions of sale apply to the purchase of goods from the E-shop. The Terms and Conditions of Sale and the legislation in force in the Republic of Estonia regulate the legal relations between Sniffy and the person purchasing products through the E-shop (hereinafter referred to as the Customer). Any differences in the Terms of Sale arising from the status of the Customer (e.g. private individual/consumer or legal entity) shall be based on the legislation in force in the Republic of Estonia.
1.2. The prices of the products sold in the E-shop, including VAT, and the product information are indicated with the products. Sniffy reserves the right to change the prices of the products.
1.3. The price is subject to a delivery charge, which depends on the location of the Customer and the delivery method. The delivery charge will be displayed to the Customer when placing the order.

  1. Making an order

2.1. To order the goods, you must add the desired products to the shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. The amount of the charge will then be displayed on the screen, which can be paid by bank transfer or other payment methods. The payment intermediary is a payment service provider, Montonio Finance UAB (registration code 3050205122), to whom Sniffy transfers the customer’s payment details.
2.2. The order shall be formalised and executed and the sales contract shall enter into force when price of the purchase is received by Sniffy. The order shall be cancelled if the Customer fails to pay for the purchase within the time limit specified in the order confirmation.
2.3. If the goods ordered cannot be delivered, the Customer will be informed as soon as possible and the money paid will be refunded.

  1. Delivery of products

3.1. To transport the products to the Customer, Sniffy will use the delivery method chosen by the Customer at the time of placing the order.
3.2. Sniffy and the transport company arranging the delivery shall not be liable for any delay or failure of delivery if the delay or failure is due to inaccuracy or incorrectness of the information provided to Sniffy by the Customer when placing the order.
3.3. The Customer may notify Sniffy of products with damaged packaging at the following address. [email protected].
3.4. Shipments delivered within the Republic of Estonia will reach the destination specified by the Customer, as a rule, within 5 working days from the date of the sales contract entering into force. On the basis of section 209 (6) of the Law of Obligations Act, Sniffy has the right to deliver the products to the Customer within 30 calendar days.
3.5. In the event that it becomes apparent that the product ordered by the Customer is not in Sniffy’s warehouse and the product is not expected to be delivered to the Customer within the normal delivery period, Sniffy shall contact the Customer as soon as possible via the contact details provided by the Customer. Sniffy will inform the Customer when Sniffy expects to be able to deliver the requested product to the Customer. In the event that the Customer has lost interest in the Product due to the delay, the Customer may withdraw from the Agreement and the amount paid by the Customer will be refunded to the Customer.

  1. Withdrawal from the contract

4.1. Products purchased in the E-shop are subject to a 14-day right of return. The customer has the right to return the products purchased from the E-shop within 14 days from the date of delivery of the product, without giving a reason, pursuant to section 56(1) of the Law of Obligations Act. In order to return a product, the Customer must first submit a withdrawal request to Sniffy by e-mail ([email protected]), stating, in addition to the request itself, the Customer’s name, the date of the order, the Customer’s bank account number and the order number. For this purpose, the Customer may use the withdrawal form available in the E-shop. Thereafter, the Customer must return the products ordered to Sniffy within 14 days from the date of submission of the withdrawal request.
4.2. The costs related to the return of the products purchased from the E-shop (e.g. postage) shall be borne by the Customer.
4.3. Returned Products must be unused and undamaged and must be in their original packaging. The returned product must contain all the items contained in the packaging. In order to preserve the right of withdrawal, the product packaging must be opened carefully and the product must be handled in a way that does not damage the product. Pursuant to Section 53(4)(4-1) of the Law of Obligations Act, the 14-day right of withdrawal does not apply, for example to foodstuffs and feedingstuffs in open packaging.
4.4. In the event of withdrawal from the contract by the Customer, the Customer shall be refunded all payments received from the Customer, including delivery costs (except for additional costs resulting from the delivery method chosen by the Customer, which differs from the cheaper standard delivery method offered by Sniffy), within 14 days of receipt of the returned goods by Sniffy at the latest. Refunds will be made to the same bank account from which the Customer paid for the purchase.
4.5. Sniffy has the right to withdraw from the sale and to demand the return of the goods from the Customer if the price of the goods in the online shop is indicated significantly below the market price of the goods due to a mistake.

  1. Right to lodge a complaint

5.1. Sniffy shall be liable for the non-conformity or defect of the goods sold to the Customer, which already existed at the time of delivery and which becomes apparent within a period of up to two years from the delivery of the goods to the Customer. During this first year after delivery of the goods to the purchaser, it shall be presumed that the defect already existed at the time of delivery. It is Sniffy’s responsibility to rebut this presumption.
5.2. The Buyer shall have the right, in the event of a defect, to contact Sniffy within two months at the latest by sending an e-mail to the following address [email protected].
5.3. Sniffy shall not be liable for defects arising after delivery of the goods due to the Customer’s action or inaction (misuse, accident, etc.) or in the case of normal wear and tear resulting from normal use of the goods.
5.4. If the goods purchased from Sniffy have defects for which Sniffy is liable, Sniffy shall repair or replace the defective goods. If the goods cannot be repaired or replaced, Sniffy shall refund to the purchaser the full amount of the fees paid under the sales contract.
5.5. Sniffy will respond to the Customer’s complaint in writing or in a format that can be reproduced in writing within 15 days.

  1. Disputes

6.1. If the Customer has any complaints about the E-shop or Sniffy, they should be sent to the following e-mail address [email protected].
6.2. The resolution of issues not provided for in the Sniffy Terms and Conditions of Sale shall be governed by the legislation in force in the Republic of Estonia.
6.3. If the Customer and Sniffy are unable to settle the dispute by negotiation and agreement, the Customer may refer the matter to the Consumer Disputes Committee. The Consumer Disputes Committee has the competence to settle disputes arising from the contract concluded between the Customer and the E-shop.   1. Other conditions

7.1. All images, specifications and other information accompanying products sold in the E-shop are protected by copyright and may not be used without the permission of Sniffy.
7.2. Sniffy reserves the right to modify the terms and conditions of sale. Amendments shall take effect from the date of publication of the amendment on the E-shop website www.sniffy.ee.
